2. Risk Disclosure & Trading Disclaimer
High-Risk Volatility: Cryptocurrency trading, spot assets, and leveraged derivative contracts involve substantial market volatility, execution slippage, liquidation risks, and potential total loss of capital. Prices can fluctuate dramatically in response to sudden regulatory actions, macroeconomic catalysts, or liquidity cascades.
No Guarantee of Future Performance: Historical win rates, simulated PnL metrics, and historical telemetry data displayed on FOMOGRAM are calculated from past mathematical models and do not guarantee future trading profits. Past algorithmic accuracy does not ensure future market success.
User Responsibility: You are solely responsible for your own trading decisions, risk tolerance, order execution, and capital allocation. Always conduct independent research and consult a licensed financial professional before entering any financial trade.
Data Accuracy & Third-Party News: Information provided on FOMOGRAM is aggregated from third-party feeds and automated models. While we strive for accuracy, FOMOGRAM does not warrant that news feeds, sentiment calculations, or real-time data are error-free, complete, or free from external manipulation.
System Availability & Execution Latency: FOMOGRAM is not liable for any losses arising from software downtime, transmission delays, API failures, or execution slippage on third-party exchanges. All trade execution remains under the sole control and discretion of the user.
3. Terms of Service
Acceptance of Terms & Contracting Entity
By accessing or using the FOMOGRAM website, mobile applications (iOS and Android), or API feeds, you agree to be bound by these Terms of Service entered into with Fomogram LLC, a Wyoming limited liability company (“FOMOGRAM”, “we”, “us”, or “our”). If you do not agree to all terms, you must immediately discontinue using our services.
Intellectual Property & Proprietary Algorithms
All software, quantitative models, proprietary scoring formulas (CSI), editorial analyses, custom user interface components, and logos are the intellectual property of FOMOGRAM. Unauthorized scraping, reverse engineering, redistribution, or commercial reselling of our data feeds is strictly prohibited.
Service Availability & Telemetry Latency
FOMOGRAM provides real-time market data sourced from official institutional feeds (Binance, TradingView) and verified news media. While we aim for maximum uptime, we do not warrant uninterrupted service or zero-latency delivery during periods of extreme market congestion or network outages.
Limitation of Liability
Under no circumstances shall FOMOGRAM, its developers, or affiliates be liable for any direct, indirect, incidental, or consequential losses resulting from trading decisions, technical errors, latency anomalies, or reliance on data presented across the platform.
Account Security & Fair Use
Subscriptions and API credentials are for individual use only. Account sharing, automated rebroadcasting of alerts, or scraping data feeds without prior written consent will result in immediate termination without refund.
Subscriptions & Refund Disclaimer
Access to digital terminal tools, live feeds, and real-time alerts is granted immediately upon subscription. Due to the real-time proprietary nature of market intelligence, subscription fees are strictly non-refundable once telemetry access is delivered.
Governing Law & Jurisdiction (State of Wyoming, USA)
These Terms of Service and any dispute or controversy arising out of or related to your use of FOMOGRAM shall be governed by, and construed in accordance with, the laws of the State of Wyoming, United States of America, without regard to conflict of law principles. Any legal suit, action, or proceeding arising under these Terms shall be instituted exclusively in the state or federal courts located in the State of Wyoming, USA.
4. Privacy Policy
Data Controller & Zero Personal Data Harvesting
The data controller responsible for the operation of the platform is Fomogram LLC, located at 30 N Gould St Ste N, Sheridan, WY 82801, USA (Email: [email protected]). FOMOGRAM is built on privacy-first Web3 principles. We do not require personal accounts, passwords, KYC identity documents, or credit card details to browse the terminal. We do not sell user data to advertising networks.
Local Storage & Device Push Tokens
To deliver high-speed experiences, we use browser localStorage to remember your selected coin filters and disclaimer acceptance state. When you opt into real-time mobile push notifications, an anonymous device push token is stored securely in our database solely to dispatch trade alerts.
Third-Party Price Feeds & Telemetry
The platform connects to official market data streams (Binance, TradingView) to render live market prices directly on your client device. These requests are subject to the standard network privacy policies of the respective infrastructure providers.
Telemetry, Analytics & Server Logs
Like most modern web applications, essential diagnostic metrics (such as anonymized IP requests, error logs, and CDN performance) are processed transiently to maintain platform security, prevent DDoS attacks, and optimize data speeds.
Opt-Out & Permanent Data / Push Token Deletion
You maintain complete control over device notifications and stored telemetry. On the FOMOGRAM iOS and Android mobile apps, you can permanently delete your anonymous device push token, server-side notification preferences, and local history at any time with a single tap via Settings → Legal & Support → Delete Push Data & Reset Device, or by emailing [email protected].
